I think more then anything it's a SHOCK because this happened 4 years ago and was in the past. They weren't expecting it and most-likely her FH never thought about it. I don't think it has a thing to do with honesty, he was honest when she found out... and the OP sounds like she didn't JUST find out, but, now that it's here... it's REAL & must be dealt with.

I'm sorry that I didn't read your post yesterday. I am a clerk for a small criminal law firm. Take a deep breath - relax - The lawyer is more than likley going to give you the worst case senario. This is so that you are prepared for the worst.

Sentencing for 1st time offenders on a simple assault can vary depending on the region and the judge and the Crown and the accused (FH). I just know that it will all work out for the best.

We have one client that has been on bail 5 years awaiting trial (EXCEPTIONAL case) but my boss went to his stag so that he could be out later then his midnight crefew. It will all work out.

Similar thing happened to my FH when we first got together. 4 months after we started dating he got arrested and charged with assault. we went to court 6 months to a year later, i was so scared. I thought he would end up in jail, even his lawyer thought the worst because of the judge he had that day, but once the whole thing started and he saw the *** between my fh and the idiot he hit plus an outburst in court from his family my fh ended up getting a conditional discharge which means it's on his record for a few years then wiped off. He had to do community service & was on probation for 2 years and couldn't travel to the U.S. for that time either and banned from the blockbuster location where the fight happened. Everything is fine now.

I'd be a tad concerned about "not knowing the whole story" about something that has the man I am marrying going to court. Shouldn't you know all the details?

I think there is no need to worry. For a first offence there is rarely a serious judgement. Probabtion is likely... but that is nothing to worry about either. We all do silly things for time to time.. i am sure that everything will work out well. You FH has been trouble free since this time and i am sure that the judge will take this into consideration.

As previous poster said a lawyer is a good thing. He needs someone to represent his interests, and it's just part of procedure.

If it's his first run in with the law he'll probably have some conditions, and be on probation for like a year. He may even be able to report to the probation officer in person one month and then by phone the next time.

I definitely would not worry about anything. Even if he has to cross the border he could probably get special permission from his probation officer, or just has to let him/her know where he's going.

I know the whole thing about going to court and legal stuff can be scary, but honestly, don't worry about it :)

They may add no alcohol as a condition of his probation. They did this with my brother because there was alcohol involved in the incident.

Also, my brother doesn't have a curfew or anything like that. He has to check in with his probation officer once a week (goes for an interview which they work around his work schedule) but he doesn't have to be home by a certain time or anything.

Again, if it's his first offence they probably won't be TOO hard on him depending on the severity of the bar fight. :)

I wouldn't worry too much! :) If they were going to send him to jail they would have done so. I'm sure he'll just be on probation at the most.

Well my FH was in a bad motorcycle accident 2 years ago. Hit a truck head on when his breaks locked up. Was hospitalized for 1 year, and is now blind in one eye. The fight happened sometime before his accident so they had to postpone the court date

I just hope things start looking up for him

Don't be worried about the lawyer! The lawyer is a GOOD thing! :D My brother's lawyer was able to explain what was happening and speak on his behalf and was able to strike a deal with the prosecution. He plead guilty to a misdemeanor assault and was released on 1 year's probation and some other minor restrictions (ex. no drinking, no drugs, must stay away from "victim"), etc.

Don't worry though. Ask your FH what the lawyer has said about the situation. I find it strange it took 4 years to get in front of a judge though ... it took my brother's case 2 months?

Yes he has a lawyer. This happened before I ever met him. And he just reminded me today that his court date was next week.

I have never really been in a situation like this before, where someone I love has court over some drunk fight. But...the fact that he has a lawyer made me even more worried.... I dunno....this is a frist for me.

Has your FH retained an attorney? Has he talked to anyone about the charges against him?

They don't just send you a notice saying, "You are being charged over a fight. See you there."

My brother went through something similar recently and since it was his first offense he is on probation for one year.

But why haven't you talked to a lawyer?!?!?!

most likely it will be a mis-dimeanor. Nothing serious unless the other guy was hurt bad. If he was hurt bad your fh could be looking at house arrest, curfew, or community service. I had a case like this I had to look into during my practicum ( I am a cim major) and really its just a slap on the wrist. Don't be worried, the crown just has to follow procedures he will probably be told that this will be on his record but stayed.

Wow, I dont' know anyone in this situation but I'm suprised he's going to court over something so minor 4 years ago unless the other guy was hurt really bad (ie paralysed, brain damage, etc) I dont' know what to say but goodluck and I hope it all works out.
