They weren't expecting it and most-likely her FH never thought about it. I am a clerk for a small criminal law firm. Take a deep breath - relax - The lawyer is more than likley going to give you the worst case senario.  This is so that you are prepared for the worst. &lt;/P&gt;&lt;P&gt;Sentencing for 1st time offenders on a simple assault can vary depending on the region and the judge and the Crown and the accused (FH).  I just know that it will all work out for the best. &lt;/P&gt;&lt;P&gt;We have one client that has been on bail 5 years awaiting trial (EXCEPTIONAL case) but my boss went to his stag so that he could be out later then his midnight crefew. I thought he would end up in jail, even his lawyer thought the worst because of the judge he had that day, but once the whole thing started and he saw the *** between my fh and the idiot he hit plus an outburst in court from his family my fh ended up getting a conditional discharge which means it's on his record for a few years then wiped off.  He had to do community service &amp; was on probation for 2 years and couldn't travel to the U.S. for that time either and banned from the blockbuster location where the fight happened. For a first offence there is rarely a serious judgement.  Probabtion is likely... but that is nothing to worry about either.  We all do silly things for time to time.. i am sure that everything will work out well. He needs someone to represent his interests, and it's just part of procedure. &lt;/P&gt;&lt;P&gt;If it's his first run in with the law he'll probably have some conditions, and be on probation for like a year. He may even be able to report to the probation officer in person one month and then by phone the next time. &lt;/P&gt;&lt;P&gt;I definitely would not worry about anything. They did this with my brother because there was alcohol involved in the incident.&lt;/P&gt;&lt;P&gt;Also, my brother doesn't have a curfew or anything like that. Hit a truck head on when his breaks locked up. Was hospitalized for 1 year, and is now blind in one eye. The lawyer is a GOOD thing!  :D  My brother's lawyer was able to explain what was happening and speak on his behalf and was able to strike a deal with the prosecution.  He plead guilty to a misdemeanor assault and was released on 1 year's probation and some other minor restrictions (ex. no drinking, no drugs, must stay away from "victim"), etc.&lt;/P&gt;&lt;P&gt;Don't worry though.  Ask your FH what the lawyer has said about the situation. Has he talked to anyone about the charges against him?  &lt;/P&gt;&lt;P&gt;They don't just send you a notice saying, "You are being charged over a fight. Nothing serious unless the other guy was hurt bad. If he was hurt bad your fh could be looking at house arrest, curfew, or community service.  I had a case like this I had to look into during my practicum ( I am a cim major) and really its just a slap on the wrist.
