| Hi Ladies, Does anyone what the repercussions are to an employer who fires someone for taking mat leave? This just happened to a friend of mine. I told her I would ask you ladies.... The labour board is investigating but it could take weeks. Just wondering if anyone has had an experience with this? Also can she apply for UI if she doesn't have enough hours because of her leave?

I don't know the details, but I do not it is not allowed and the employer can be sued. I did a paper on pregnancy discrimination last year, and there are TONS of law suit cases here and in the states that are being filed and won. Tell her to keep pushing and maybe ask a lawyer for some advice?

That is DEFINATELY illegal! I dont know what the exact repercussions are, but I hope your friend gets it dealt with soon. Keep us updated

Yup completely illegal, if she can prove she was fired b/c she's pregnant. As for EI, unless she has the right amount of hours I don't think she does get it, but have her call services Canada.

I know someone! And i was SOOOOOOO shocked to hear it! She worked at the NHS (Hospital) and went off on mat leave....well somehow they got around the law and told her she wasn't needed for that job anymore and gave her a buyout.....(so basically she got fired!)
THEN turned around 1 yr later (so 1 yr after the time she was to come back) and hired someone for the job she previously did!
but I'm telling ya, somehow they did it all legally..........b/c the Hospital wouldn't do it unless they ran it through their RISK department AND through HR......So, how scary is that????

I'm not sure of the repercussions although, I'm sure they're fierce... a tall oak tree and some rope come to mind though! How absolutely disgusting.

| Thanks for the advice, when she was due to go back to work her boss changed her days around on her, she filed a claim about it, and 1 month later they fired her! They would constantly ask her if she was preggers again, hope they can the guy!
